TERMS AND CONDITIONS OF SALE

These Terms and Conditions govern the purchase of products sold through the website bsdesign.it.
By placing an order on the website, the Customer declares to have read, understood, and accepted these Terms and Conditions of Sale.
1. SELLER INFORMATION
The website bsdesign.it and the products sold through it are managed by:

2. THE BSDESIGN PROJECT
BSDESIGN is an independent project born from an original creative process.
The DROP 01 collection represents the first launch of the project and consists of a limited selection of products: four T-shirts and one hat.
The products originate from ideas, concepts, graphics, creative direction, and design developed by BENEDETTO SAVARESE for BSDESIGN and are subsequently produced through selected manufacturing partners.
Production by third parties exclusively concerns the material realization of the products and does not alter the creative and independent nature of the project.
DROP 01 is offered in limited quantities. Once a product, size, or variant is sold out, BSDESIGN does not guarantee that it will be produced or made available again.
3. PRODUCTS
The main characteristics of each product are indicated on its respective product page.
BSDESIGN takes particular care to ensure that photographs, colors, graphics, and descriptions represent the products as accurately as possible.
However, slight differences in color perception may depend on the characteristics and settings of the screen used by the Customer.
As these are textile products manufactured through production processes, minimal tolerances in measurements, seams, prints, embroidery, or other processing elements may also be present, provided that such variations do not constitute a lack of conformity under applicable law.
Indications regarding sizes, measurements, and fit are intended to help the Customer in choosing the product.
The Customer is therefore invited to carefully consult any size guides on the website before completing the order.
4. AVAILABILITY AND LIMITED NATURE OF DROPS
BSDESIGN products may be produced and marketed in limited quantities.
The presence of an item on the website does not guarantee its availability until the order is completed.
In the event of simultaneous purchases, technical errors, or exceptional stock discrepancies that render an already ordered product unavailable, BSDESIGN will promptly inform the Customer.
If payment has already been made, the amount related to the unavailable product will be refunded.
The depletion of an item does not entail any obligation for BSDESIGN to restock, reprint, or re-produce it.
5. PRICES
All product prices are expressed in Euros (€) and include applicable taxes, where provided.
Any shipping costs are indicated separately before the order is concluded.
The applicable price is the one displayed on the website at the time the order is submitted.
BSDESIGN reserves the right to change product prices at any time for future purchases.
Any price changes will not affect orders already concluded.
In case of an obvious material or technical error in the price display, BSDESIGN will inform the Customer before processing the order, allowing them to confirm the purchase at the correct price or to cancel it and receive a full refund of any amount already paid.
6. PURCHASE PROCEDURE
To make a purchase, the Customer must:

choose the available size or variant, where provided;

add the product to the cart;

enter the requested data;

indicate the shipping address;

select the payment method;

review the order summary;

accept the applicable conditions;

definitively confirm the purchase.
Before definitive confirmation, the Customer has the opportunity to verify and correct any errors in the entered data.
Submitting the order entails the obligation to pay.
Following the completion of the purchase, BSDESIGN will send a communication containing the order summary to the email address provided by the Customer.
BSDESIGN reserves the right not to accept or cancel an order in cases provided by law, in the presence of payment issues, product unavailability, clearly incorrect data, or fraudulent or abusive activities.
If payment has already been made and no sum is legitimately due, a refund will be issued.
7. PAYMENTS
Payment can be made using the methods available and indicated directly during the checkout phase.
Transactions may be managed through external payment service providers.
BSDESIGN does not directly store complete payment card data when these are processed by their respective providers.
The order will be processed after correct payment authorization, unless different methods are provided by the specific payment method selected.
8. SHIPMENTS
BSDESIGN ships to the destinations made available during checkout.
Any shipping costs are communicated to the Customer before the completion of the purchase.
Any preparation and delivery times indicated on the website are estimates, unless a binding delivery date is expressly stated.
During a Drop launch, promotions, or periods characterized by a high number of orders, preparation times may vary.
BSDESIGN will nevertheless do everything reasonably possible to prepare and entrust orders to the carrier within the communicated times and in compliance with the terms provided by applicable law.
The Customer is required to provide a correct and complete delivery address.
BSDESIGN cannot be held responsible for delays or delivery problems resulting from incorrect or incomplete information provided by the Customer, without prejudice to the mandatory rights provided by law.
The risk related to the products passes to the consumer Customer as provided by applicable law at the time of delivery.
9. RECEIPT OF ORDER
Upon delivery, the Customer is invited to check the condition of the package.
If the package appears visibly damaged, opened, tampered with, or compromised, it is advisable to document its condition with photographs and promptly report it to:
Failure to report immediately does not result in the loss of rights recognized to the consumer by current legislation regarding product conformity.
10. RIGHT OF WITHDRAWAL
The Customer who purchases as a consumer has the right to withdraw from the purchase, without the need to state a reason, within 14 days from the date on which they physically take possession of the product, as provided by current legislation.
To exercise the right of withdrawal, it is necessary to unequivocally communicate your decision by writing to:
The communication must allow identification of the Customer and the order concerned.
Subsequently, the necessary instructions for making the return will be communicated.
The Customer must return the product within the terms provided by applicable law.
Unless otherwise indicated by BSDESIGN or in cases where the law stipulates otherwise, the direct costs of returning the product are borne by the Customer.
The Customer is obliged to handle the product only to the extent necessary to ascertain its nature, characteristics, size, and fit.
The Customer may be held responsible for any decrease in the value of the product resulting from handling other than that necessary to establish its nature and characteristics.
Products must therefore be returned preferably:

clean;

unwashed;
-
undamaged;
-
free from odors, stains, or obvious signs of use;
-
complete with any tags;
-
complete with accessories received;
-
in the best possible condition.
The removal of tags does not automatically imply the loss of the right of withdrawal when the latter is provided by law, but it may be evaluated together with the overall condition of the product for the purpose of any decrease in value.
The limited nature of a Drop or the possible exhaustion of a size or product does not limit the right of withdrawal recognized by law.
11. REFUNDS
In case of a valid exercise of the right of withdrawal, BSDESIGN will proceed with the refund of the amounts due as provided by applicable law.
The refund will be made using the same payment method used for the purchase, unless otherwise agreed with the Customer.
In cases permitted by law, BSDESIGN may suspend the refund until the returned products are received or until the Customer has provided proof of shipment of the same, if earlier.
Any additional costs resulting from the Customer's choice of a more expensive delivery method than the standard method offered by BSDESIGN will not be refunded.
Return costs for simple change of mind remain the responsibility of the Customer, unless otherwise indicated.
12. SIZE EXCHANGES
If the Customer wishes to change the size of a product, they can contact:
Any exchange will only be possible based on the availability of the product and the new size requested.
Given the limited nature of BSDESIGN Drops, the availability of an alternative size cannot be guaranteed.
If an exchange is not available, the Customer may exercise the right of withdrawal within the terms and conditions provided by law.
13. INCORRECT, DAMAGED, OR DEFECTIVE PRODUCTS
The right of withdrawal for simple change of mind is distinct from the protection provided for defective, damaged, or non-conforming products.
If the Customer receives an item different from the one ordered or believes that the product has a defect of conformity, they must contact:

In the presence of an actual lack of conformity, the remedies and protections provided by current legislation apply.
In cases covered by the legal warranty, the necessary costs for the application of the remedies provided by law are not charged to the consumer.
14. LEGAL WARRANTY OF CONFORMITY
All products sold to consumers through bsdesign.it are covered by the legal warranty of conformity provided by current legislation.
For new goods, the consumer benefits from the protection provided by law for defects of conformity existing at the time of delivery and manifested within the period provided by applicable law.
The seller's liability period is normally two years from the delivery of the product, without prejudice to any different terms provided by applicable mandatory law.
A product is compliant when, among other things:

it matches the description provided;

it possesses the indicated characteristics;

it presents reasonably expected qualities and performance;

it is suitable for the use for which goods of the same type are normally intended.
In the presence of a defect of conformity, the consumer has the right to the remedies provided by law, which may include repair or replacement and, in specified cases, price reduction or contract termination.
The legal warranty does not cover deterioration or damage caused by:

improper use of the product;

failure to follow washing instructions;

treatments not suitable for the material;
-
normal wear and tear;
-
accidental damage;
-
interventions or modifications made after purchase and which are the cause of the problem found.
All mandatory rights recognized to the consumer remain, in any case, reserved.
15. PRODUCT CARE AND WASHING
To preserve the quality of BSDESIGN T-shirts, hats, prints, embroidery, and other product elements over time, the Customer is invited to follow the washing and maintenance instructions on the product label or possibly indicated on the relevant product page.
The use of temperatures, washes, detergents, or treatments incompatible with the reported instructions can compromise fabrics, colors, prints, embroidery, and fit.
16. INTELLECTUAL AND CREATIVE PROPERTY
The BSDESIGN project arises from an activity of original ideation, creative development, and design.
Within the limits provided by applicable law, all original content attributable to BSDESIGN is protected, including, by way of example:

creative concepts;

graphics;
-
artwork;
-
illustrations;
-
original compositions;
-
design;
-
logos;
-
distinctive signs;
-
naming;
-
photographs;
-
videos;
-
advertising campaigns;
-
texts;
-
descriptions;
-
editorial materials;
-
promotional materials;
-
social media content;
-
graphic and visual elements of the website.
The purchase of a BSDESIGN product involves only the purchase of the physical good.
The purchase does not entail the transfer to the Customer of any intellectual property rights related to the graphics, content, brand, or creative project.
Unless prior written authorization from BSDESIGN, the reproduction, copying, modification, distribution, or commercial use of original content is prohibited to the extent that it is protected by applicable law.
It is also forbidden to use photographs, graphics, logos, artwork, or other materials belonging to BSDESIGN for the purpose of marketing counterfeit products, imitations, or third-party products by presenting them as originals.
17. USE OF THE BSDESIGN TRADEMARK
The name BSDESIGN, its logo, and any distinctive signs used on the website and products may not be used in a way that generates confusion about the existence of commercial relationships, partnerships, authorizations, or collaborations with BSDESIGN.
It is forbidden to present oneself as an official reseller, distributor, representative, or authorized partner of BSDESIGN without specific authorization.
18. RESALE OF PRODUCTS
The purchase of products by the consumer is intended primarily for personal use.
Any subsequent legitimate resale of an original product by the owner remains governed by applicable law.
It is not permitted to use the name BSDESIGN, related photographs or official materials in such a way as to make a private or independent sale appear as a sale made directly by BSDESIGN.
19. LIMITATION OF LIABILITY
BSDESIGN cannot be held responsible for the impossibility or delay in fulfilling its obligations if this depends on circumstances not reasonably controllable.
However, no provision of these Terms and Conditions can be interpreted as an exclusion or limitation of liability or rights that cannot be excluded under current legislation.
20. PRIVACY AND PERSONAL DATA
The processing of personal data takes place in compliance with the applicable legislation on personal data protection.
For more information, the Customer is invited to consult the Privacy Policy available on the website.
The use of cookies and similar technologies is governed, where applicable, by the related Cookie Policy.
21. COMMUNICATIONS
For communications related to:

22. COMPLAINTS AND DISPUTE RESOLUTION
In case of a problem related to a purchase, the Customer is invited to first contact BSDESIGN at:

The consumer can also make use, where applicable, of the alternative consumer dispute resolution tools provided by current legislation.
23. APPLICABLE LAW AND COMPETENT COURT
These Terms and Conditions are governed by Italian law, without prejudice to the consumer's right to benefit from any more favourable mandatory provisions provided by applicable law.
For any disputes with a Customer acting as a consumer, the competent court shall be the judge identified according to the applicable mandatory rules and, in cases provided for by law, the court of the place of residence or domicile of the consumer.
24. CHANGES TO THE TERMS AND CONDITIONS
BSDESIGN reserves the right to modify or update these Terms and Conditions for regulatory, commercial, technical or organizational needs.
The changes will be effective for purchases made after their publication on the website.
For orders already concluded, the conditions in force at the time of purchase will continue to apply.
25. FINAL CLAUSE
Should any provision of these Terms and Conditions be declared invalid, ineffective or unenforceable, the remaining provisions shall continue to be effective within the limits permitted by law.
For anything not expressly regulated by these Terms and Conditions, the Consumer Code, the Civil Code and other applicable Italian and European provisions apply.
